Compensation Lawyer

Super Girl

If you have suffered a work-related injury or illness, been injured in a vehicle accident, or someone has been negligent and caused you harm, it can be distressing and life-changing. The sooner you engage a lawyer to deal with your compensation claim, the better, and our lawyers at PK Simpson can help you through it all. We’re here to support you and to do everything we can to help you receive the compensation you deserve so you can get back on your feet and get the care and financial help you need.

At PK Simpson we have top lawyers who specialise in all aspects of their chosen profession and who can help you win your case and receive the compensation to which you are entitled. We communicate with you in plain English, and we also know the terminology used when lawyers deal with compensation cases can seem like another language to people who aren’t well versed in the language of the law. The jargon is complicated – law students spend years studying it – so unless you’re a lawyer, it can be a nightmare trying to wade through it. At PK Simpson we know how to translate so you are clear about what is happening every step of the way.

Compensation Lawyers NSW: How a Claim Is Assessed

An initial assessment should identify the type of injury, how it occurred and which compensation pathway may apply. A lawyer can then consider the responsible insurer or party, the evidence available and whether any notice or lodgement step requires urgent attention.

Because requirements and time limits differ between workers compensation, motor accident, public liability and medical negligence matters, a general deadline should not be applied to every claim. Obtain advice promptly so a lawyer can check the rules against your dates and circumstances.

The assessment should leave you with a practical next-step plan. This may include preserving evidence, obtaining records, notifying the correct organisation, responding to an insurer or considering a review or dispute process.

For over 45 years, PK Simpson has helped people in Australia to make successful compensation claims.

We are a personal injury law firm that charges on a No Win – No Fee basis – we don’t simply pick and choose the cases we’re likely to win – and we win over 99 per cent of cases!

Lawyers Are Best at Battling Big Insurance Firms

You could end up with less compensation than you deserve if there is even a minor legal error in your case, which is why it is crucial to engage the best lawyers to handle it. A good lawyer can help your claim meet each legal requirement. PK Simpson lawyers have been winning compensation cases for years so we know every difficulty that can arise and we have the experience to handle them all. Big insurance companies will do everything they possibly can to deny you the right to compensation, but with PK Simpson on your side, you can be assured that we will go into battle for you.

We know every insurance trick in the book, so our lawyers can help to stop any legal shenanigans used by the insurer’s team to try to reject your compensation claim. If you had to deal with the insurance company or their lawyers, you’d no doubt find it very frustrating and intimidating. So, let PK Simpson lawyers do it all for you. If your claim has been rejected, we know how to deal with an appeal and to make sure the playing field is equal.

What to Bring to Your First Consultation

Prepare a short chronology covering what happened, when symptoms began, treatment received and how the injury has affected work and daily life. Bring any claim numbers, insurer or employer correspondence, incident reports, medical certificates, test results and contact details for witnesses.

Employment and earnings records may help where income loss is relevant, while receipts can document treatment, travel or other injury-related expenses. Do not delay seeking advice merely because a record is missing; tell the lawyer what exists and where it may be obtained.

The Law Society of NSW recommends giving your solicitor the relevant facts and documents, asking questions and agreeing on communication expectations. A clear file can help the lawyer assess the matter efficiently.

Compensation Claims We Fight For at PK Simpson

Motor vehicle accidents are the most common form of personal injury compensation claims made in Australia. However, there are many other personal injury claim areas where compensation is available and where PK Simpson lawyers are experts:

  • Workplace accidents
  • Motor Vehicle accidents
  • Public Place accidents
  • Inability to work due to injury or illness
  • Private place accidents
  • Whole injury damages claims (Common Law Claims)
  • Medical negligence

How to Choose an Injury Compensation Lawyer

Look for experience in the compensation pathway relevant to your injury, not only general personal injury experience. Ask who will manage the file day to day, how updates will be provided and which decisions will require your instructions.

Specialist accreditation can be another useful credential, but it belongs to an individual solicitor rather than an entire firm. You can learn about and verify the credential through the Law Society of NSW Specialist Accreditation Scheme.

Questions for a Compensation Claim Lawyer

  • Which compensation scheme or legal pathway may apply to my circumstances?
  • What immediate notices, evidence or deadlines should I address?
  • Who will handle my matter, and how often will I receive updates?
  • What legal fees, disbursements and other costs could I pay under the proposed agreement?
  • What are the likely stages, key risks and possible alternatives to formal proceedings?

The answers should be specific enough for you to understand the proposed approach without promising a particular result. Compensation outcomes depend on the facts, evidence and law applying to the individual matter.

At PK Simpson, we have all the necessary skills, experience, and personnel to manage any compensation matter. If you or someone you know has suffered injury or illness and feel that you may be entitled to claim compensation, contact PK Simpson on 1300 757 467 or book an appointment to come and see us to have a chat, or email enquiries@pksimpson.com.au.

What Does a No Win No Fee Compensation Lawyer Cost?

A No Win No Fee compensation lawyer should provide a written conditional costs agreement that explains what counts as a successful outcome and when professional fees become payable. Before signing, check the estimate, the method used to calculate fees and whether an uplift fee may apply.

No Win No Fee does not necessarily waive every possible cost. Depending on the claim and agreement, you may still face some disbursements, such as court fees, or an adverse costs order if litigation is unsuccessful. PK Simpson pays for medical reports where relevant; eligible workers compensation disputes may have legal fees and reports funded through IRO. Ask which costs could apply to your matter.

Terms vary, so ask for each potential cost and risk to be explained in writing. The Law Society of NSW guidance on solicitor charges explains conditional costs agreements, disbursements, uplift fees and costs orders.
