NSW Police Injury Claim Lawyers
Our New South Wales police officers and other teams of emergency service workers are on duty 24 hours a day, seven days a week, year-round keeping people safe.
Police officers have to deal with all kinds of risks from life-threatening assaults and horrific fatal car accidents to watching people, including babies and children, die despite every effort to save them. Those are only some police injury cases where sufferers claim compensation for an injury sustained on duty.
Apart from physical injury, an officer can suffer a serious psychological injury that can severely affect their ability to work leaving them with the only option of having to claim compensation. Severe stress due to the trauma police often suffer on the job can lead to Post Traumatic Stress Disorder (PTSD) and the associated depression, anxiety and suicidal thoughts and, unfortunately, sometimes actions.

Police Injury Compensation Differs From Others
If you are an injured police officer in NSW and have been hurt while on duty, your entitlements to police injury compensation differ from other workers in the State.
We have outlined the differences below but rest assured the team at PK Simpson police injury lawyers have a long history of success acting for NSW police officers who have been injured in the line of duty.
See your GP after any sort of injury at work. Medical evidence is vital to all compensation claims in terms of how and when it was caused and the extent of injury. Your injuries may deteriorate over time as well and treatment notes will clarify this. You should report your injuries to your employer as soon as possible after it occurs.

For Police Officers Sworn in Prior to April 1, 1988
If you have suffered a police injury whilst performing your duties as a NSW police officer, and this injury prevents you from working in this capacity, we can help you to seek a medical discharge. It’s important to seek legal advice before you apply for a medical discharge to preserve your entitlements following any determination of your capacity for performing duties within the NSW Police Force.
Pension or Superannuation Allowance For Police Injury
If you are medically discharged from the NSW Police Force and your police injury is deemed to have been due to an accident or illness while on duty, you can seek to increase your superannuation pension or allowance.
You may be wondering “Is a police injury pension for life?’ The answer is yes, provided the incapacity is “hurt on duty” (HOD), i.e. work-related. A HOD pension is for life and can be increased to 100 per cent of the wages you received as a NSW police officer at the time of your medical discharge, as long as you meet the regulations concerning a pension increase.
The regulations include your capacity for employment and your service history. If you were sworn in before 1 April 1988 and you are medically discharged from the NSW Police Force, you are urged to seek legal advice on police injury on duty compensation.
Lump Sum Compensation Claim for Police Injury
If you are a NSW police officer injured while working for the NSW Police Force or as a result of your duties and this is deemed a permanent impairment, you may be eligible to claim lump sum compensation, which may include compensation for pain and suffering.
Medical and Other Treatment Expenses
You ought to contact PK Simpson today if your treatment expenses for an injury suffered whilst working as a police officer are refused by the NSW Police Force even though you have been medically discharged.
The NSW Police Force is required to agree to all reasonable applications for expenses incurred as a result of your work injury and that can include medical treatment, medications and domestic help.
Common Law Claims
Should the NSW Police Force be found negligent in their duty of care towards you as a police officer employed by them, then you must contact PK Simpson’s police injury lawyers to discuss the possibility that you have a right to a lump sum for lost wages, past and future treatment costs and also your pain and suffering. NSW Police can still claim pain and suffering monies unlike most other workers in NSW.

For Police Officers Sworn in After April 1, 1988

Our experienced team can help you obtain the following:
- Weekly compensation benefits
- Lump sum compensation for permanent impairment
- Coverage for medical treatment and rehabilitation
- Pain and suffering compensation, where applicable
- Support through the Personal Injury Commission process
- Assistance with work injury damages claims
Work Injuries Damages (WID) Claims
Should you suffer physical or psychological injuries at work, and that injury is due to employer negligence (the NSW Police Force), or if the negligence contributed to your injuries, you may be able to make a work injury damages claim.
Before you can take action against the Police Force in NSW, you must meet certain requirements and thresholds. Our team can assist you in understanding these requirements and guide you through the claims process.
